Terms and Conditions of Use:

1. Preamble:
These terms of Use (“Terms”), together with any and all other documents referred to herein, govern the relationship between you and LC Wakaful Digital Sdn Bhd, being owner operator of GoBarakah - Smart Giving E-Vouchering Platform (“we”, “us”, “our” or “GoBarakah”) under which our GoBarakah E-Vouchers (“Services”) are provided by us through (i) our website and platform https://gobarakah.com (“Website”); and (ii) within any app provided by us, collectively known as the “GoBarakah Platform”.
Please note, that GoBarakah is directed to people residing in Malaysia. We do not represent that content available on or through our website/platform is appropriate for use or available in other locations. The Services are operated by LC Wakaful Digital Sdn Bhd, which is a company registered in Malaysia.

Please read these Terms carefully. By accessing and using the GoBarakah platform together with any content, you confirm you have read, understand, and accept these Terms. We will also require you to read and accept our Privacy Notice and any applicable terms and conditions which relate to the Services provided by us through the use of the e-voucher platform, if you are a registered user. We recommend that you print a copy of these terms for future reference.
If you do not accept these Terms, please do not access the GoBarakah platform or use its Services.

2. Nature of GoBarakah's E-Vouchers:
2.1. GoBarakah's e-vouchers are digital products offered and sold by programme owners as a way to raise funds/resources/contributions/donations to be distributed as assistance e-vouchers to deserving beneficiaries in a controlled and transparent manner.
2.2. These e-vouchers are not vendor-specific and are not owned by any particular vendor. Only upon redemption by the beneficiary at a particular vendor location will the vendor receive payment for any goods or services rendered.

2.3. GoBarakah's e-vouchers come in multiple formats:
- Single use e-vouchers
- Partial redemption e-vouchers
- Zero value e-vouchers

2.4. The e-vouchers are categorized in these main categories and may have different methods of redemptions:
- Store e-vouchers (physical retail shops or online stores)
- Medical e-vouchers
- Food e-vouchers
- Education fees assistance e-vouchers
- Utilities assistance e-vouchers
- Cash donation e-vouchers
Other types of customized e-vouchers may be added from time to time without advance notice.

2.5. The e-vouchers have an expiry date. The duration of the validity of the e-vouchers is set by programme owners.

3. The User Types on GoBarakah:

3.1: Public/Individual/Organizational Purchasers or Donors
a) All purchases made on the GoBarakah platform are considered final and non-refundable.
b) Purchasers or donors acknowledge that their contributions in the form of e-vouchers will be utilized for social assistance programmes as outlined on the platform.
c) GoBarakah reserves the right to utilize the funds contributed for the intended purpose, and purchasers or donors agree to the allocation of their contributions accordingly.
d) Purchasers or donors understand that they will not have ownership rights over the e-vouchers once purchased, and they will be transferred to the designated programme owners or organizations for distribution to beneficiaries.

3.2: Organizations or Programme Owners
a) All e-voucher purchases made on the GoBarakah platform are considered final and non-refundable.
b)Programme owners or organizations acknowledge that they will have ownership of e-vouchers once purchased, to be assigned (distributed) to beneficiaries according to their designated programmes.
c) Unutilized e-vouchers may be cancelled and reassigned to new beneficiaries if three months have elapsed since the initial issuance.
d) Programme owners or organizations agree to abide by the Laws of Malaysia and ensure that their programmes comply with all legal regulations.
e) GoBarakah reserves the right to recall any programmes that contravene the Laws of Malaysia or violate the terms and conditions of the platform.

3.3: Vendors or Redemption Points
a) Vendors or redemption points agree to honour and accept the e-vouchers issued by GoBarakah and commit to providing goods or services as specified on the programme page for the e-vouchers.
b) Vendors will not sell banned items such as liquor or cigarettes to beneficiaries of the e-vouchers.
c) Vendors will not engage in any misuse of e-vouchers, including exchanging store vouchers for cash without explicit permission from the platform operator.
d) Vendors will receive payment on T+1 from the withdrawal date, with payments processed on working days only (Monday to Friday).
e) Vendors have the right to refuse e-vouchers that may be presented by someone other than the beneficiary on record, to ensure the integrity of the redemption process.
f) Vendors may choose to terminate the vendor relationship with GoBarakah by providing 60 days' notice to admin@wakafuldigital.com. During this notice period, vendors are required to continue honoring and accepting the e-vouchers issued through the GoBarakah platform.

3.4: Beneficiaries (Individual or Institutional)
a) Beneficiaries acknowledge that the e-vouchers issued to them are for their personal use and cannot be transferred or sold to others.
b) Beneficiaries agree to utilize the e-vouchers for the specified purpose as outlined by the programme owner or organization.
c) Beneficiaries understand that any misuse or fraudulent activity involving the e-vouchers may result in legal action and the termination of their eligibility for future assistance.
d) Beneficiaries are encouraged to report any issues or concerns regarding the redemption of e-vouchers to the platform operator for resolution.

4. Changes to these terms
We may amend these Terms from time to time. Every time you wish to use the GoBarakah platform, please check these terms to ensure you understand, and agree to the terms that apply at that time.

5. Accessing GoBarakah's platform and Services
Access to GoBarakah is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services we provide without notice.
5.1. We will not be liable if for any reason GoBarakah E-vouchers or its related services is unavailable at any time or for any period.
5.2. We do restrict access to some parts of our Website or Platform, to users who have registered with us as opposed to general visitors.
5.3. f you are given a user identification code, password, or any other security-related information, you must keep it confidential and not share it with anyone else. We reserve the right to deactivate any user identification code or password, whether you chose it or we assigned it, if we believe you have violated any of these Terms. You are responsible for ensuring that you have the necessary arrangements to access the GoBarakah platform. Additionally, you must ensure that anyone accessing the platform through your internet connection is aware of and complies with these Terms.

6. Termination
6.1. We can terminate your use of GoBarakah e-vouchers and platform at any time and without notice if it deems that you have breached these Terms or uploaded any material to any part of the platform that is false or misleading, or against the law or any applicable regulations, or for any other reason it determines is appropriate.
6.2. This termination is without prejudice and will not affect any pending payments owing to vendors.

7. Limitation of Liability
7.1. We exclude all implied conditions, warranties, representations, or other terms that may apply to the GoBarakah platform and e-vouchers or any content on it.
7.2. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: use of, or inability to use, the GoBarakah platform and its e-vouchers; or use of or reliance on any content displayed on the GoBarakah platform.
7.3. In particular, we will not be liable for loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss or damage.

8. Intellectual Property Rights
8.1. We own all rights, title, and interest in and to all of its intellectual property in the GoBarakah Platform. You acknowledge and agree that GoBarakah owns all intellectual property rights in its platform solutions.
8.2. Expressly as stated herein, these Terms do not grant you any rights to, or in, or any other rights or licenses in respect of our Services. We are the owner or the licensee of all intellectual property rights in and to the GoBarakah Platform, and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the GoBarakah Platform (collectively, the “Content”) and in and to the material published on it and the trademarks, service marks, and logos contained therein (the “Marks”)
